Cohen and Wolf Attorney Kaelyn Mostafa Claims Lemon Law Victory Against Ford Motor Company
After an arbitration hearing before the Connecticut Department of Consumer Protection, Attorney Kaelyn Mostafa won a lemon law award of over $80,000 for Norwalk client and consumer, Kelly S. Daniel. The favorable arbitration decision ordered leading U.S. auto manufacturer, Ford Motor Company, to refund Ms. Daniel the vehicle contract price, finance charges for the loan, and consequential damages, including attorney’s fees, cost of vehicle’s charger, and other incidental costs.

On April 12, 2023, Ms. Daniel purchased a 2022 Mustang Mach-E from a dealer in Stamford. After a dusting of snow one winter evening, Ms. Daniel’s unoccupied and parked vehicle spontaneously rolled itself down her driveway three separate times, despite the vehicle being turned off and the parking brake engaged. Even though Ford determined that there were no repairs to be made for the serious rolling condition, Ms. Daniel ceased operating the vehicle and secured the back wheels when parked due to serious safety concerns.
After determining that the consumers’ vehicle met the eligibility requirements for relief under Chapter 743b of the Connecticut General Statutes (nicknamed the “lemon law”), Attorney Mostafa filed a complaint with the Department of Consumer Protection. The lemon law arbitration hearing was held on May 7, 2024, and the decision was issued on June 18, 2024 in favor of the consumer.
